ADMIN - Trademarks and TB2K

--------------------------------------------------------------------------------

Please note:

I have recently initiated Trademark registration proceedings for the following terms:

Timebomb2000

TB2K

Watching the World Tick Away

Why did I do this?

To protect our right to use those terms as descriptors for this forum. Had I not done so, any of the hate sites could have initiated that procedure, and once the registration was granted, legally disallow me/us from using those terms as descriptions for this forum. So, at nearly $300 per term (gag), I simply had no choice but to make that happen. Although the procedure will take several months, the FILING for registration effectively pre-empts the hate sites from succeeding in stealing those terms from us.

FYI

As a side note, any web site using those terms will have to remove them, or face action from the US Patent and Trademark Office, once the registrations are finalized. (And it won't cost me a cent in legal fees.) Also note the addition to the Copyright notice at the bottom of every page.

Any site actually using those terms? The first 2 are years out of date & the last just stupid.

But whatever turns his crank...

Maybe he will do the same for Lard Ass, Fatboy, TB2Gay, TB2KKK, Uncle Buck, and Chub.

He better raise enough to take on the attorneys of Prentice Hall Publishing if he thinks that he can impinge upon the copyright name of Yourdon's book.

Or is this appeal an IQ test to gauge whether he has adequately preened his flock?

TB2Gay isn't listed. Alternative forums will continue to thrive.

Instead of the stated objective, what would be achieved is that any trademark registration could force search engines to purge their cache such that folks cannot gain access to documentation that DO does not want them to see.

It's solely an impingement on freedom of speech. Today's sheeple will pay for DO to potentially have more liberty to con future forum recruits.

I think one of us should let Ed know....

Any volunteers? Wouldn't Lardass have a hissy fit if Ed contacted him about registering those terms.

Ed: Listen Uncle Buck...errr..... I mean Dennis, you can't register something that I have already copyrighted and coined.

Lardass: But Ed, it is only to stop the haters from using those terms. They hate meeeee....and they are showing all my followers what a complete idiot I am. I never posted as "Uncle Buck"....God's truth...

Ed: I think you are just setting the members up for more "donations" for another of your lardassian schemes. Enough is enough. STFU RTFN or else!

Lardass: Did I tell you, Ed, I love the azure blue of your eyes when you are mad....it gets me hot!

I received this from an "Old timer" in a PM:

"I'd post this but would prefer to keep a lower profile for now...What bothers me about DO's threat to seek trademark protection of Timebomb2000, etc., is that those terms morally belong to Yourdon. I don't see where he says he at least made a courtesy contact of Yourdon to seek his blessing. DO must be getting way with it because so few remaining members go back to the Greenspun days. And of course amusing that the sheeple are so quick to think anyone would waste $300 a pop to steal those terms out from under him..."

What did I tell you? Fleataxi is talking fundraisers!

Fleataxi

Dennis:

this might be a good fundraiser for TB2K. There are litterally hundreds of companies that can make coffee mugs, bumper stickers, tee shirts, etc. on demand/small quantities.

If you got orders from everyone, and marked them up 100% to cover your time/trouble, everyone would get some cool swag, and you could clear over $5 grand easy if enough people order.

Yes but he would have to report the income and pay sales tax in the states that require it.

Cribbage tried to warn DO about the Prentiss Hall conflict and got labeled a troll immediately. Mein Fuhrer is NOT allowing anyne to question his wisdom.

And then he starts a poll that so flagrantly self serving it stinks worse than the manure pile out behind the pigpen.

He claimed he incorporated - now he's claiming that he needs to spend some more of other people's money to nail down some particular words/phrases.

It's just $$$$$$$$$$$$$$$$$$$$$.

HA!  Good luck slobber-bone.  I had a bunch of that crap made up to give my staff, just a little morale booster.  By the time it was all said and done, with the artwork transfer, load to the manufacturer database, applied to the product and shipped, it ended up costing me $13 to give them a $2 coffee mug.

What slack jawed glassy eyed drooling idiot would pay LardAss $25 for a coffee mug?  Oops, ofrgot who I was talking about there for a second... Never mind.

BTW, don't you have to actually be engaged in trade to register a trademark?  So WTF is DO selling, besides cult-flavored KoolAid?

This is just so Paris Hilton (registering "that's hot"). Coca cola is registered internationally, yet we can still post pictures of coke, write the name coke, take pictures of an ice cold Coca Cola, discuss coke, have a drink, and a smile!
We just can't market a product under the names or slogans coke uses.

Plus the infringement has to be exact, Timebomb (y2k)(fulltopic) (two thounand)ect. are not infingement. only the exact 3 words, and only in marketing a product/service.

He incorporated last year. That's different from registering a trade or service mark.

He filed for a service mark - same as a trademark, but for services.
And BTW, his filing fees were $275 per term, not $300.

Thanks for welcome.

Oh, and I forgot to mention that he didn't use an attorney to file (so the extra bucks didn't go for that) or it would be listed on the application.

IIRC Fatboy stated during the last fundraiser that he took in enough "membership fees" that he had just enough to make it to the September Fundraiser. Where did he come up with the $900.00 for this latest development?

He may have payed an attorney for filing as a corporation, but he didn't for the service mark.  Nor did he pay anyone for due diligence on searching the terms - a real company would normally do this.  If he had, he may have saved two-thirds of the filing fees plus expenses he'll incur trying to get these marks.

We already know Timebomb2000 is in question because of Yourdon's book, but nobody has mentioned yet (at least that I've seen) that there is already a website: www.tb2k.com that was started in 1999.

I'm thinking that maybe "Watching the world tick away" will be approved.

Yes it was but the point I was trying to make is that at some point before the September fundraiser he will be $900.00 short unless he took in more than he claimed.
