Hi BBSAM....Lardass hired an attorney and had him draft a "Cease and desist " letter. It means squat in legalese. It is saber rattling basically. Letters mean nothing.
Court orders are a different matter. I don't know if UB got one or not. I did not get one and probably won't. (Did you catch that , Lardass? I didn't get one....LOL)
Lardass is still claiming that I am Vipper to his sycophants. They of course believe the stupid jerk and are drowning in his particular brand of urine-laced koolaid.

Kat, thank you for the info. I just would hate myself (In a non-sexual, internet kind of way) if anything I did made real problems for Uncle Bob or you, or anyone except LardAss. So, I'm glad to see it's just more of the same.
I wish someone would tell Hizzhole that he had NOTHING to do with UB's closing down. It makes me feel icky to think he's proud of himself for any of this.
I would bet his lawyer doesn't know he is instigating more by posting about it. I know in most cases such as this you are told to cease, and also to prevent a counter suit or having your case thrown out. Most judges would not look kindly upon you starting **** with people who you want to quit messing with you. Actually it really depends on what the C&D was if was from calling his wife or pastor then maybe that is reasonable, but if it was to stop postings about him, then if he posts about anything pertaining to this subject he pretty much opens the flood gates.
So who all got C&D letters? Were they sent to board owner/admins? And/or individuals responsible for certain posts? What exactly was to NOT be posted? And who was to publicly apologize for what?
I can understand the 'no contact with DO or family' part - taking it into the real world, if that was for a fact done, is out of line. But the rest of it...? The original located posts from Usenet were already out there and therefore, public record. There's a penalty for reposting material already out there?
That is why it is so insane....Dennis posted the stuff and is denying it and blaming Vipper who had nothing to do with it and HE KNOWS he posted those ads.
He is either really very stupid or mentally ill and he believes what he says. I don't know which it is at this point.
The ONLY reason Vipper contacted his church was to stop him from threatening her. He continued accusing her and claimed she would be living out of a cardboard box when he got through with her. This is not the first time he has accused her of things she is innocent of. She has had enough.
As far as I am aware she is the only one who got a letter. (Which means absolutely nothing)

I have never in my life heard a lawyer ask someone to apologize. In a C&D it says to stop something, even in a court case a judge would not in most cases make anyone say they were sorry. Makes me wonder what kind of lawyer this is handling it for him.
The one thing that has come to mind in this whole thing is the slander accusation. I'm not sure he can claim slander he is pretty well known and has even been in news stories before, which would make (please forgive me for allowing him to have even a bigger head) a pseudo celeb. If I remember right you can't do much about what people say about you if you are in the public eye. Now the calling his family may have crossed the line a little and in that case C&D is applicable, but in order for anything like this to warrant any kind of charges would require a restraining order. Now the C&D order would have to list in most cases who could not be contacted and the lawyer would have to have their permission to include them in the C&D. You can't just say don't contact people. Maybe he does have that, but it does raise a question in my mind.
The apology part is a problem for me. Apologise to whom & in what venue? The alleged slander - if it is indeed alleged - took place in a public venue yet the addressee is ordered to no longer post on... whatever subject they're asked in the C&D letter to not post at. Clearly then, the apology is not to be posted anywhere said slander is alleged to have occurred. And in the case of Bob's, it's gone.
So is the apologizer supposed to send a letter to the apologee? Take out a personal ad or rent air time? Is Bob supposed to resurrect TO for an express period of time in order for heretofore mentioned aplogy to take place? What will satisfy this request? Do all or a significant percentage of those who read the alleged slander have to sign off on having read/seen/heard the apology?
Cease and desist... both are variants of the word stop. Adding an apology request takes it out of the realm of a proper C&D request letter, does it not?

A good lawyer will tell you when you don't have much of a case, but if you really want to spend your money, you can always find a lawyer somewhere that will be happy to take it.
