No damages for student who said 'That's so gay'

POSTED: 9:00 a.m. EDT, May 16, 2007


SANTA ROSA, California (AP) -- A judge ruled Tuesday that a high school student who sued after being disciplined and then mercilessly teased for using the phrase "That's so gay" is not entitled to monetary damages.

Sonoma County Superior Court Judge Elaine Rushing said she sympathized with 18-year-old Rebekah Rice for the ridicule she experienced at Maria Carrillo High School. But, the judge said, Rice's lawyers failed to prove that school administrators had violated any state laws or singled the girl out for punishment.

"All of us have probably felt at some time that we were unfairly punished by a callous teacher, or picked on and teased by boorish and uncaring bullies," the judge wrote in a 20-page ruling. "Unfortunately, this is part of what teenagers endure in becoming adults."

The law "is simply too crude and imprecise an instrument to satisfactorily soothe deeply hurt feelings," Rushing said.

The case filed by Rice and her parents in 2003 brought widespread attention to a three-word phrase that some teenagers use to mean "stupid" or "uncool," but has come under attack as an insensitive insult to gay people.

The Rices argued that a teacher violated Rebekah Rice's First Amendment rights by sending her to the principal's office and putting a note in her school file. During a trial in February, Rebekah Rice testified she said "That's so gay" as a response to other students asking her rude questions about her Mormon upbringing.

Rushing said the school district was not liable for monetary damages because the law under which the Rices brought the lawsuit specifically excludes schools. In addition, she said that school officials are given wide latitude in deciding how to enforce non-discrimination provisions of the state education code.

The judge added that it didn't make sense to have the referral stricken from the girl's school record, since she graduated last year.

The lawsuit also accused the public high school of having a double standard because, it said, administrators never sought to shield Rebekah from teasing based on Mormon stereotypes. It also alleged that the Rices were singled out because of the family's conservative views on sexuality.

Rushing rejected each claim, going so far as to suggest that the Rices had created a miserable situation for Rebekah by advertising their dissatisfaction with the school's handling of the incident during her freshman year.

Neither the Rices nor their lawyer returned telephone calls seeking comment.

grantbo, since gays have been around since the beginning of time and we know that regardless of what we do as a society we can't stop the behavior, is it better to keep them hidden away in "the closet", where they marry the opposite sex, have children, then sneak out and have homosexual relations, or is it better to let them be who or what they are? just a thought..............

If anyone needs an example, here's exactly the kind of thing I was referring to in my reply to Dennis's poll about what we really think of this place. This garbage really does get quite tedious after awhile.

You bring up a very good point. I'll leave the gushy 'tolerant', 'understanding', 'forgiving' wanting to 'help', to the many many others who are so inclined. I think these abominations and their supporters have made their choice, and no amount of persuasion will change their black hearts. As they become 'normalized' in our society, they become more free to spread their parasitic evil. I'm not inclined to 'love the sinner'; I'd rather make them aware that they are an evil blight on this earth.

I guess my point is that they are going to be "spreading their parasitic evil" regardless of what society thinks. The only difference is they will get married etc... as a cover and end up hurting alot of innocent people.

Why is it that most of the people who gush "love the sinner, hate the sin" nonsense about gays do NOT say the same thing about cretins who beat 90 year old women, monsters who rape toddlers to death and teens who set dogs on fire??

When is it you people are going to climb down off your high horses and ALLOW GOD TO BE THE DECIDER OF WHAT IS ABOMINABLE AND UNACCEPTABLE. You can't claim to believe and worship God and still refuse to get you fanny off HIS throne and quit playing God, even contradicting and judging God's wisdom in saying that.

Santa Rosa has a large base of lesbian and homosexual employees and any judge, especially this unqualified judge, could only come back with such a ruling. Seems to me God did decide. Didn't you read the bible? It's pretty clear. And that knowledge combined with my God given wisdom allows me to make clear thinking judgements. The "love the sinner, hate the sin" argument is just a way to muzzle Christians.

I'd rather ride a high horse then lay with vermin anyday.

I tend to agree with Chartreuse on this one---and I am as conservative as they come.

That is the stupidest thing I've ever heard and continue to hear.  There is no separation of the person and the action, the person is the source of the action.  There is no "good people do bad things", that's total bullsh1t - bad people do bad things.

Actually, no where in the Bible does it say we are to love the sinner and hate the sin. That was a statement by one of the early Church Fathers, if I am not mistaken.

Christ never said that, nor God.

Actually, it was St. Augustine first and then later Martin Luther re-stated it in the 1500's, Eric. Gandhi was just reiterating the same unbiblical idea.

First, we need to understand that "Love the sinner, hate the sin" is not Scriptural. It is a doctrine of man, first formulated by St. Augustine and later affirmed by Martin Luther. So it got into Catholic teaching and then was transferred intact into Protestantism. But it never was based on Scripture, and it never was true.

I tend to agree with Chartreuse on this one---and I am as conservative as they come.
